Terms and Conditions

  1. The landlord rents to the tenant the apartments located at Erlenweg 5 and 5a in Börgerende for use as holiday apartments for a maximum of 4 persons.

    The tenant is entitled to use the parking space belonging to the holiday apartment during the rental period.

    For the duration of the rental period the tenant receives an apartment key. It must be returned to the landlord when the rented property is handed back.

  2. Smoking is not permitted in the apartment.

  3. The tenancy begins and ends as stipulated in the rental agreement. In accordance with Section 549 (2) no. 1 of the German Civil Code (BGB), the living space is rented for temporary use only. The right of termination of the tenant and the landlord is governed by the statutory provisions.

  4. The rent and any additional services are to be paid in the amount stated in the rental agreement before the start of the tenancy.

  5. A claim to the reservation of the holiday apartment exists only if the deposit is paid on time (amount and date as stated overleaf).

  6. Before the start of the tenancy the tenant provides the landlord with security in the form of a deposit in the amount stated in the rental agreement. After the rented property has been returned, the tenant is entitled to the return of the security, less any costs for replacing items damaged by the tenant or other claims of the landlord arising from the tenancy.

  7. The fireplace is used at your own risk. Ash may only be disposed of once it has cooled down.

  8. The landlord does not clear snow and ice from the property.

  9. The landlord makes the apartment available on the day of arrival from 4:00 pm. The tenant undertakes to treat the rented property and the rooms, facilities and installations intended for shared use with care and consideration, and to ensure adequate ventilation and heating of the rooms provided. If a not merely insignificant defect in the rented property becomes apparent, or if a precaution is required to protect the rented property or the premises against an unforeseen danger, the tenant must notify the landlord immediately. The tenant is liable for damage caused by culpable and grossly negligent breach of the tenant’s duty of care and notification, in particular if technical installations and other facilities are handled improperly, the rooms provided are insufficiently ventilated or heated, or are not protected against frost. The tenant is also liable for the fault of the tenant’s agents.

  10. The apartment is equipped with a washing machine. For insurance reasons, the tap to the washing machine hose must always be turned off again after using the washing machine.

  11. The tenant must vacate the apartment on the day of departure by 10:00 am at the latest. The tenant must hand it over in proper condition. The final cleaning does not include cleaning the cooking facilities, washing the dishes and pots, cleaning the grill and the fireplace, or disposing of household waste in the bins provided for this purpose. These duties lie with the tenant.

  12. The tenant may cancel the booking at any time before the start of the trip. The cancellation must be declared in writing or by email. The decisive date for the cancellation is the receipt of the cancellation notice by Grit Scholz, Grunowstr. 20a, 13187 Berlin, or by email at info@blick-aufs-meer.de or haus-am-deich-boergerende@web.de. If the tenant cancels, the landlord is entitled, from the signing of the contract, to compensation for the reservation made in the following amount:

    • up to 30 days before the start of the tenancy 15% of the accommodation costs
    • 29 - 20 days before the start of the tenancy 30% of the accommodation costs
    • 19 - 10 days before the start of the tenancy 75% of the accommodation costs
    • less than 9 days before the start of the tenancy 90% of the accommodation costs.
  13. If the landlord cannot make the accommodation available for a certain travel period for the contractually agreed purpose (accommodation ban), the tenant has a right to cancel free of charge for this travel period without cancellation fees.

  14. The municipality of Börgerende-Rethwisch is a recognised tourist resort and levies a tourist tax per day and person aged 16 and over of €1.00 in the low season (1 Oct – 30 Apr) and €2.00 in the peak season (1 May – 30 Sep), which is billed via the landlord. The day of arrival and the day of departure count as one day of stay. As an overnight guest in our holiday apartment you are liable to pay the tourist tax.

  15. There are no agreements other than those made in this contract. No verbal side agreements have been made. Amendments or additions to this contract must be made in writing.
